L'emploi ne commence ou ne se termine pas officiellement avec un simple contrat. Il doit \u00e9galement \u00eatre officiellement notifi\u00e9 \u00e0 Jobsplus.<\/p>\n\n\n\n<p>En vertu de la <strong><a href=\"https:\/\/legislation.mt\/eli\/cap\/594\/eng\/pdf\" data-type=\"link\" data-id=\"https:\/\/legislation.mt\/eli\/cap\/594\/eng\/pdf\" rel=\"nofollow noopener\" target=\"_blank\">Loi sur les services d'emploi et de formation (chapitre 594 des lois de Malte)<\/a><\/strong>, Les employeurs sont l\u00e9galement tenus d'informer Jobsplus lorsqu'un employ\u00e9 commence \u00e0 travailler et lorsqu'il est mis fin \u00e0 son emploi. Ces notifications font partie du syst\u00e8me national d'enregistrement de l'emploi de Malte et constituent un \u00e9l\u00e9ment essentiel de la conformit\u00e9 de l'employeur.<\/p>\n\n\n\n<p>Alors que le cadre juridique est en place depuis des ann\u00e9es, les attentes en mati\u00e8re d'application de la l\u00e9gislation sont plus fortes en 2026. Les d\u00e9lais de d\u00e9claration font l'objet d'un suivi plus \u00e9troit et la conformit\u00e9 est de plus en plus li\u00e9e \u00e0 une r\u00e9glementation plus large en mati\u00e8re de main-d'\u0153uvre, en particulier en ce qui concerne l'emploi de ressortissants de pays tiers.<\/p>\n\n\n\n<h2 id=\"the-four-working-day-rule-explained\" class=\"wp-block-heading\">La r\u00e8gle des quatre jours ouvrables expliqu\u00e9e<\/h2>\n\n\n\n<h5 id=\"employers-are-required-to-submit-the-engagement-form\" class=\"wp-block-heading\">Les employeurs sont tenus de soumettre le formulaire d'engagement :<\/h5>\n\n\n\n<div class=\"wp-block-group is-style-cnvs-block-bg-inverse\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<ul class=\"wp-block-list is-style-cs-list-styled-positive-circle-1 has-medium-font-size\">\n<li>Le premier jour de travail du salari\u00e9<\/li>\n\n\n\n<li>Au plus tard quatre jours ouvrables \u00e0 compter de la date de d\u00e9but effectif<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<p class=\"has-text-align-center\"><strong>Le m\u00eame d\u00e9lai de quatre jours ouvrables s'applique lorsque l'emploi prend fin et qu'un formulaire de licenciement doit \u00eatre d\u00e9pos\u00e9.<\/strong><\/p>\n\n\n\n<p>En pratique, le d\u00e9p\u00f4t le premier jour est l'approche la plus s\u00fbre. La p\u00e9riode de quatre jours ouvrables est un maximum l\u00e9gal, et non une p\u00e9riode de gr\u00e2ce administrative.<\/p>\n\n\n\n<p>Les formulaires d'engagement et de r\u00e9siliation doivent \u00eatre soumis par l'interm\u00e9diaire de l'Agence europ\u00e9enne pour la s\u00e9curit\u00e9 et la sant\u00e9 au travail. <strong><a href=\"https:\/\/jobsplus.gov.mt\/\" data-type=\"link\" data-id=\"https:\/\/jobsplus.gov.mt\/\" rel=\"nofollow noopener\" target=\"_blank\">Portail de services en ligne pour les employeurs Jobsplus<\/a><\/strong>, Il s'agit du canal de notification standard pour les employeurs. Les proc\u00e9dures internes doivent donc garantir que l'acc\u00e8s au portail est actif avant la date d'entr\u00e9e en fonction de l'employ\u00e9.<\/p>\n\n\n\n<p>Il existe des exceptions limit\u00e9es. Il est certain que <strong>inscriptions d'ind\u00e9pendants et cas d'employeurs familiaux<\/strong> peuvent \u00eatre soumises par courrier \u00e9lectronique plut\u00f4t que par le biais du syst\u00e8me en ligne.<\/p>\n\n\n\n<p>Lorsque les formulaires doivent \u00eatre envoy\u00e9s par courrier \u00e9lectronique, ils doivent \u00eatre envoy\u00e9s \u00e0 l'adresse suivante :<\/p>\n\n\n\n<div class=\"wp-block-group is-style-cnvs-block-bg-light\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<ol class=\"wp-block-list\">\n<li><strong>Malte :<\/strong> <a>hriu.jobsplus@gov.mt<\/a><\/li>\n\n\n\n<li><strong>Gozo :<\/strong> <a>hriuforms.jobsplus@gov.mt<\/a><\/li>\n<\/ol>\n<\/div><\/div>\n\n\n\n<p class=\"has-text-align-center\"><strong>Les employeurs doivent conserver la preuve de la soumission et tout accus\u00e9 de r\u00e9ception re\u00e7u. Une documentation claire fait partie d'une bonne gestion de la conformit\u00e9.<\/strong><\/p>\n\n\n\n<div class=\"wp-block-group is-style-cnvs-block-bg-light\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<p>Il est \u00e9galement important de comprendre que les envois tardifs sont signal\u00e9s de mani\u00e8re visible sur le portail Jobsplus Employer Online Services. Les formulaires soumis en dehors du d\u00e9lai l\u00e9gal sont marqu\u00e9s d'une \u00e9toile, ce qui permet d'identifier les retards dans le syst\u00e8me. La date de d\u00e9livrance de cette autorisation permet effectivement \u00e0 l'employ\u00e9 de commencer \u00e0 travailler pour l'employeur agr\u00e9\u00e9.<\/p>\n\n\n\n<p>Toutefois, le permis lui-m\u00eame ne remplace pas l'obligation de l'employeur d'informer Jobsplus. Lorsque l'employ\u00e9 commence physiquement \u00e0 travailler, le formulaire d'engagement doit \u00eatre soumis d\u00e8s le premier jour ouvrable et au plus tard dans les quatre jours ouvrables suivant la date de d\u00e9but effectif.<\/p>\n\n\n\n<p>Le m\u00eame principe s'applique en cas de cessation d'emploi. Les employeurs sont l\u00e9galement tenus d'envoyer le formulaire de licenciement dans les quatre jours ouvrables suivant la date effective de licenciement. Cette obligation n'est pas discr\u00e9tionnaire. Les d\u00e9lais de d\u00e9claration ne sont plus aussi souples que par le pass\u00e9 et les retards peuvent avoir des cons\u00e9quences administratives.<\/p>\n\n\n\n<p>Pour les employeurs qui embauchent des ressortissants de pays tiers, le respect des d\u00e9lais est encore plus important. Les retards dans la d\u00e9claration d'engagement ou de cessation d'emploi peuvent avoir une incidence sur le traitement des autorisations d'emploi et des permis uniques, ce qui risque de perturber le
