Det er vigtigt at forst\u00e5 disse forskelle for b\u00e5de arbejdsgivere og arbejdstagere, is\u00e6r p\u00e5 et arbejdsmarked, der i stigende grad omfatter fleksibelt arbejde, fjernarbejde og s\u00e6sonarbejde.<\/p>\n\n\n\n<p>Alle ans\u00e6ttelseskontrakter i Malta er reguleret af <strong>Lov om besk\u00e6ftigelse og arbejdsmarkedsrelationer (EIRA)<\/strong> og overv\u00e5get af <strong>Institut for Industri- og Besk\u00e6ftigelsesrelationer (DIER)<\/strong>. Nedenfor er der en klar opdeling af hver ans\u00e6ttelseskategori, og hvad den indeb\u00e6rer.<\/p>\n\n\n\n<h3 id=\"indefinite-permanent-employment\" class=\"wp-block-heading\">Ubestemt (permanent) ans\u00e6ttelse<\/h3>\n\n\n\n<p>En tidsubegr\u00e6nset eller permanent ans\u00e6ttelseskontrakt har <strong>ingen fast slutdato<\/strong> og forts\u00e6tter, indtil en af parterne lovligt opsiger den. Det er Maltas mest almindelige og sikre ans\u00e6ttelsesform.<\/p>\n\n\n\n<div class=\"wp-block-group is-style-cnvs-block-bordered\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Pr\u00f8vetid:<\/strong> Standardperiode p\u00e5 <strong>seks m\u00e5neder<\/strong>, kan udvides op til <strong>Et \u00e5r<\/strong> for roller p\u00e5 h\u00f8jere niveau (ud\u00f8vende, teknisk eller administrativ), der tjener <strong>det dobbelte af den nationale mindstel\u00f8n<\/strong>.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Opsigelsesperioder:<\/strong> Skal\u00e9r med service - fra <strong>en uge<\/strong> (under seks m\u00e5neder) op til <strong>tolv uger<\/strong> (efter ti \u00e5r).<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Regel om suspension:<\/strong> Hvis medarbejderen tager mere end <strong>to ugers berettiget orlov<\/strong> Under pr\u00f8vetiden s\u00e6ttes uret p\u00e5 pause og genoptages, n\u00e5r man er tilbage p\u00e5 arbejdet.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Opsigelse:<\/strong> Der skal f\u00f8lge et ordentligt varsel eller en juridisk begrundelse - vilk\u00e5rlig afskedigelse uds\u00e6tter arbejdsgiveren for krav.<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-orange-color has-alpha-channel-opacity has-orange-background-color has-background is-style-wide\"\/>\n\n\n\n<p class=\"has-text-align-center\"><em>Det er Maltas \u201cstandard\u201d-ans\u00e6ttelsesform, som giver langsigtet sikkerhed for medarbejderne og forudsigelighed for arbejdsgiverne.<\/em><\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-orange-color has-alpha-channel-opacity has-orange-background-color has-background is-style-wide\"\/>\n\n\n\n<h3 id=\"fixed-term-definite-employment\" class=\"wp-block-heading\">Tidsbegr\u00e6nset (bestemt) ans\u00e6ttelse<\/h3>\n\n\n\n<p>En tidsbegr\u00e6nset ans\u00e6ttelseskontrakt l\u00f8ber i en <strong>specifik varighed<\/strong> eller indtil en <strong>s\u00e6rligt projekt<\/strong> er afsluttet. Den skal altid have en klart defineret start- og slutdato.<\/p>\n\n\n\n<div class=\"wp-block-group is-style-cnvs-block-bordered\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Varighed:<\/strong> M\u00e5 ikke overstige <strong>fire \u00e5r<\/strong> i alt, inklusive fornyelser.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Minimumsperiode:<\/strong> Som regel <strong>seks m\u00e5neder<\/strong>, medmindre objektive grunde berettiger et kortere engagement.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Pr\u00f8vetid:<\/strong> <strong>Proportional<\/strong> til kontraktl\u00e6ngden - f.eks. en 6-m\u00e5neders kontrakt = 2 m\u00e5neders pr\u00f8vetid; kontrakter over 15 m\u00e5neder = op til 6 m\u00e5neder.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Tidlig opsigelse:<\/strong><\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list is-style-cnvs-list-styled\">\n<li>Hvis <strong>arbejdsgiveren slutter tidligt<\/strong> (ikke for d\u00e5rlig opf\u00f8rsel), skal de betale <strong>halvdelen af den resterende l\u00f8n<\/strong>.<\/li>\n\n\n\n<li>Hvis <strong>medarbejder fratr\u00e6der f\u00f8r tid<\/strong>, skylder de den samme andel.<\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Fornyelse:<\/strong> N\u00e5r de samme opgaver forts\u00e6tter, <strong>ingen ny pr\u00f8vetid<\/strong> g\u00e6lder.<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-orange-color has-alpha-channel-opacity has-orange-background-color has-background is-style-wide\"\/>\n\n\n\n<p class=\"has-text-align-center\"><em>En tidsbegr\u00e6nset kontrakt b\u00f8r afspejle et reelt midlertidigt behov, f.eks. et projekt eller en s\u00e6sonbestemt eftersp\u00f8rgsel, snarere end at blive brugt til at omg\u00e5 tidsubegr\u00e6nsede ans\u00e6ttelsesforpligtelser.<\/em><\/p>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-orange-color has-alpha-channel-opacity has-orange-background-color has-background is-style-wide\"\/>\n\n\n\n<h3 id=\"part-time-employment\" class=\"wp-block-heading\">Deltidsbesk\u00e6ftigelse<\/h3>\n\n\n\n<p>I Malta indeb\u00e6rer en deltidsans\u00e6ttelseskontrakt typisk <strong>omkring 20 timers arbejde om ugen<\/strong>, Det er cirka halvdelen af en standard fuldtidsplan p\u00e5 40 timer. Det n\u00f8jagtige antal kan variere afh\u00e6ngigt af rolle eller sektor, men deltidsansatte arbejder altid f\u00e6rre timer end sammenlignelige fuldtidsansatte, mens de nyder godt af <strong>samme rettigheder og fordele p\u00e5 pro rata-basis<\/strong>.<\/p>\n\n\n\n<div class=\"wp-block-group is-style-cnvs-block-bordered\"><div class=\"wp-block-group__inner-container is-layout-constrained class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Pro rata-rettigheder:<\/strong> Ret til alle personalegoder (ferie, sygedagpenge, bonusser, helligdage) <strong>forholdsm\u00e6ssigt<\/strong> til arbejdstimer.<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Fair behandling:<\/strong> M\u00e5 is-style-cnvs-list-styled\">\n<li><strong>Regel for konvertering:<\/strong> Hvis det gennemsnitlige antal timer over et \u00e5r svarer til eller overstiger fuldtidstimer, bliver medarbejderen <strong>p\u00e5 fuld tid<\/strong> ved lov.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Skriftlig aftale:<\/strong> Timer, opgaver og l\u00f8n skal is-style-cnvs-list-styled\">\n<li><strong>Aftale p\u00e5kr\u00e6vet:<\/strong> Begge parter skal underskrive en skriftlig \u00e6ndring, der beskriver den nye tidsplan og varighed.<\/li>\n\n\n\n<li><strong>Pro-rata fordele:<\/strong> L\u00f8n og rettigheder (ferie, bonusser osv.) justeres i forhold til det reducerede antal timer.<\/li>\n\n\n\n<li><strong>Tilbage til fuld tid:<\/strong> Vilk\u00e5rene for at vende tilbage til fuld tid skal v\u00e6re klart angivet.<\/li>\n\n\n\n<li><strong>Kontinuitet:<\/strong> Medarbejderen bevarer sin fuldtidsstatus i forhold specifikt driftskrav.<\/li>\n\n\n\n<li><strong>Agenturets regler:<\/strong> Fra og med <strong>Juni 2024<\/strong>, kun <strong>DIER-licenserede agenturer<\/strong> under <strong><a href=\"https:\/\/legislation.mt\/eli\/ln\/2023\/270\/eng\" rel=\"nofollow noopener\" target=\"_blank\">Juridisk meddelelse 270 af 2023<\/a><\/strong> kan stille vikarer til r\u00e5dighed.<\/li>\n\n\n\n<li><strong>Ligebehandling:<\/strong> Midlertidigt ansatte skal have samme grundl\u00f8n og arbejdsvilk\u00e5r som sammenlignelige fuldtidsansatte.<\/li>\n\n\n\n<li><strong>Fornyelser:<\/strong> Gentagne forl\u00e6ngelser kan resultere i, at ans\u00e6ttelsen behandles som tidsubegr\u00e6nset, hvis den ikke er beh\u00f8rigt 2008<\/a><\/strong>, udstedt i henhold til<a href=\"https:\/\/legislation.mt\/eli\/cap\/452\/eng\/pdf\" rel=\"nofollow noopener\" target=\"_blank\"> <strong>Lov om besk\u00e6ftigelse og arbejdsmarkedsrelationer (kap. 452)<\/strong><\/a>. I praksis betyder telearbejde, at en medarbejder udf\u00f8rer sine opgaver <strong>regelm\u00e6ssigt og frivilligt fra et andet sted end arbejdsgiverens kontor<\/strong> - typisk hjemmefra eller i andre godkendte omgivelser - samtidig med at man holder sig digitalt forbundet med arbejdspladsen.<\/p>\n\n\n\n<div class=\"wp-block-group is-style-cnvs-block-bordered\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<ul class=\"wp-block-list is-style-cnvs-list-styled\">\n<li><strong>Skriftlig aftale:<\/strong> Skal tydeligt angive arbejdstider, brug af udstyr, kommunikationsordninger og databeskyttelsesforpligtelser.<\/li>\n\n\n\n<li><strong>Lige rettigheder:<\/strong> Fjernansatte har samme vilk\u00e5r og beskyttelse som ansatte p\u00e5 stedet.<\/li>\n\n\n\n<li><strong>Sundhed og sikkerhed:<\/strong> Arbejdsgivere skal s\u00f8rge for et sikkert arbejdsmilj\u00f8, ogs\u00e5 uden for arbejdspladsen.<\/li>\n\n\n\n<li><strong>Databeskyttelse:<\/strong> Al overv\u00e5gning og datah\u00e5ndtering skal v\u00e6re i overensstemmelse med <strong>GDPR<\/strong> og interne IT-politikker.<\/li>\n<\/ul>\n<\/div><\/div>\n\n\n\n<hr class=\"wp-block-separator has-text-color has-orange-color has-alpha-channel-opacity has-orange-background-color has-background is-style-wide\"\/>\n\n\n\n<p><em>Telearbejde er en <strong>Arbejdsordning<\/strong>, Det er ikke en separat kontrakttype.
